Terms of Use

These Terms of Use ("Terms") govern your access to and use of smbCloud Mail, the MailX client apps, and smbcloudmail.com (together, the "Service"), provided by Splitfire AB ("Splitfire AB," "smbCloud," "we," "us," or "our"), a company registered in Stockholm, Sweden. By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

smbCloud Mail is a hosted email service. MailX is the client app you use to read and send mail through it, available on the web, iOS, macOS, Android, Linux, and Windows. We offer a free hosted inbox on the shared @smbcloud.email domain, a Personal Pro plan for your own domain, and Business plans for teams that need custom-domain email with multiple mailboxes.

2. Accounts and Eligibility

You must provide accurate information when creating an account and are responsible for keeping your login credentials confidential and for all activity that happens under your account. You must be at least 16 years old, or the age of digital consent in your country if higher, to create an account. If you create an account on behalf of a business, you confirm you have the authority to bind that business to these Terms.

3. Free and Paid Plans

The free plan gives you a hosted inbox on @smbcloud.email at no cost, for as long as your account remains active and in good standing. Personal Pro and Business plans are paid subscriptions billed on a recurring basis — monthly unless stated otherwise at checkout — until you cancel. Depending on the platform you sign up through, billing is processed by Stripe (web) or through Apple's or Google's in-app purchase systems (mobile apps), and is subject to their respective terms in addition to these Terms. Subscriptions renew automatically at the price shown at the time of purchase unless you cancel before the renewal date. You can cancel a web subscription from your account settings, and a mobile subscription through your Apple ID or Google Play account settings. We do not prorate partial billing periods except where required by law.

4. Acceptable Use

The Service exists to help legitimate businesses and individuals send and receive email. You agree not to use it to send spam, unsolicited bulk mail, phishing attempts, malware, or other content that violates applicable anti-spam or electronic communications laws (including CAN-SPAM and GDPR-derived rules); to relay mail on behalf of someone else without authorization; to interfere with the Service's operation or attempt to bypass its security or deliverability controls; or to use the Service in any way that infringes another party's rights. We monitor for abuse because it affects deliverability for every user on the platform, and we may suspend or terminate accounts that violate this section, with or without notice, depending on severity.

5. Your Content

You own the content of the email you send and receive through the Service. We process that content only as needed to operate the Service — for example, to deliver, store, index, and display your mail, and to run the on-device MailX AI assistant features you choose to use. 6. Third-Party Services

The Service relies on third parties to operate: Stripe for web payment processing, Apple's App Store and Google Play for mobile app distribution and in-app billing, domain registrars for Personal Pro and Business domain purchases, and Onde Inference for the on-device AI features in MailX. Your use of those integrations is also subject to the relevant third party's own terms.

7. Intellectual Property

The Service — including its software, design, and branding, but excluding your own content — is owned by Splitfire AB or its licensors and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, reverse engineer, or create derivative works from the Service except as permitted by law.

8. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service, and will make reasonable efforts to give you notice and a chance to export your data first, except where immediate action is needed to protect the Service or other users.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every email will be delivered — email delivery depends in part on systems outside our control.

10. Limitation of Liability

To the extent permitted by law, Splitfire AB will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits or lost data, even if advised of the possibility. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will post the updated Terms here with a new "Last updated" date, and where appropriate notify you by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of Sweden, without regard to its conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence.
